What is an Internal Committee (IC)?
Under the SHWW Act, every workplace with 10 or more employees must constitute an Internal Committee to receive and inquire into complaints of sexual harassment. It must be headed by a senior woman employee and include an external member.
Who needs an External Member?
Every Internal Committee is legally required to include one external member drawn from an NGO or association committed to the cause of women, or a person familiar with issues relating to sexual harassment. This ensures impartiality in inquiries.
What is the penalty for non-compliance?
Failure to constitute an IC or comply with the Act can attract a fine of up to ₹50,000, and repeat offences can lead to a doubled penalty, cancellation of licence, or withdrawal of registration to conduct business.
What is the POSH Annual Report?
Under Section 21, the IC must file an annual report with the employer and the District Officer detailing the number of complaints received and disposed of during the year. It is a mandatory yearly filing that many organisations overlook.
