Draft ESI (General) Regulations, 2026: Key Changes Every Employer Must Know

Based on the Draft ESI (General) Regulations, 2026 issued under the Social Security Code, 2020, the Employees’ State Insurance framework is set for a major procedural modernization. The draft regulations consolidate and update the existing ESI regulations, introducing greater digitization, streamlined compliance processes, and clearer timelines for employers, employees, and the ESIC administration.

Draft ESI Regulations, 2026: A Step Towards Digital and Simplified Compliance

The Employees’ State Insurance Corporation (ESIC) has released the Draft ESI (General) Regulations, 2026 under the Social Security Code, 2020. These regulations aim to replace the existing ESI procedural framework and align ESI administration with the new labour codes.

Some of the key proposed changes include:

  • Complete digitalization of employee registration, contribution filing, and benefit claims.
  • Monthly Return of Contribution (ROC) filing by employers through the designated portal.
  • Electronic generation of Insured Person (IP) Cards.
  • Defined timelines for payment of contributions and settlement of benefits.
  • Simplified procedures for sickness, maternity, disablement, dependants’ and funeral benefits.
  • Greater emphasis on electronic records, online communication, and technology-driven compliance.

The draft regulations also strengthen provisions relating to accident reporting, maintenance of employee records, benefit administration, and grievance redressal.
