Rajasthan Takes a Major Step Towards Implementing the OSH Code
The Government of Rajasthan has officially notified the Rajasthan Occupational Safety, Health and Working Conditions Rules, 2026 under the Occupational Safety, Health and Working Conditions Code, 2020.
The Rules were published in the Rajasthan Gazette (Extraordinary) on 30 June 2026 and have come into force from the date of publication. The notification follows the public consultation process conducted after the draft rules were issued on 3 February 2026.
This marks another significant milestone in the implementation of the Labour Codes across India.
Why is this Notification Important?
The Rajasthan OSH Rules replace multiple state-specific provisions relating to:
* Factory registration and licensing
* Occupational safety standards
* Health requirements

* Beedi & Cigar establishments

Major Highlights of the Rajasthan OSH Rules, 2026
1. Digital Registration of Establishments
One of the biggest reforms is complete digitalisation.
Employers are required to apply electronically through the official Labour Department portals.
Registration applications, document uploads, fee payment and certificate issuance will all be online.
2. Deemed Registration
If the competent authority fails to process a complete application within the prescribed timeline, the establishment will be deemed registered, and the registration certificate will be auto-generated.
This provides certainty to businesses and reduces delays.
3. Single/Common Licence for Factories
Factories can obtain a Single Licence/Common Licence valid for up to 10 years.
This significantly reduces the burden of annual renewals.
Applications are to be filed electronically through the official portal.
4. Auto-Renewal of Factory Licence
Once the renewal application is filed with prescribed fees, the licence will be auto-generated online.
Late applications attract an additional fee of 25%.
5. Online Compliance System
Almost every major compliance is now online:
* Registration
* Licence
* Renewal
* Amendments
* Factory plans
* Commencement notice
* Closure notice
* Accident reporting
* Disease reporting
* Change of manager
This reflects the government’s move towards paperless labour administration.
Mandatory Annual Medical Examination
A significant new employer obligation has been introduced.
Employers of:
* Factories
* Building & Other Construction establishments
* Beedi & Cigar establishments
must arrange free annual medical examinations for every employee aged 40 years and above.
The examination must be completed within 120 days from the commencement of every calendar year.
Mandatory Appointment Letter
No employee can be employed without an appointment letter.
The Rules prescribe a detailed format covering:
* Employee details
* Aadhaar
* LIN
* UAN/ESIC Number
* Designation
* Skill category
* Wage details
* Allowances
* Social Security coverage
* Nature of duties
Existing employees must also be issued appointment letters if not already provided.
Accident Reporting Made Stringent
Employers are required to immediately report:
* Fatal accidents
* Serious injuries
* Dangerous occurrences
* Occupational diseases
Reports must be submitted electronically in prescribed forms.
The Rules also contain an exhaustive list of “Dangerous Occurrences” requiring mandatory reporting, including:
* Explosion
* Crane collapse
* Fire
* Chemical leakage
* Building collapse
* Scaffold collapse
* Hazardous substance leakage
* Electrical flash-over
* Major chemical spills
Safety Committees
Factories and establishments employing 500 or more workers must constitute a Safety Committee.
Key features include:
* Equal employer and worker representation
* Meetings every quarter
* Three-year tenure
* Review of accidents
* Risk assessment

* SOP reviews
* Workplace inspections
* Monitoring implementation of recommendations
Mandatory Safety Officers
The Rules prescribe minimum Safety Officer requirements.

Separate norms have also been prescribed for:

Registration Fees Prescribed
The Rules prescribe detailed fee structures for:
* Factories
* Contract Labour establishments
* Building & Other Construction
* Motor Transport Undertakings
* Newspaper establishments
* Audio-Visual establishments
* Other establishments
Late registration attracts 25% additional fee.
Integration with EPFO & ESIC
An important digital reform is that commencement and cessation information submitted under the Rules will be automatically shared with EPFO and ESIC, reducing duplication of reporting.
State Occupational Safety & Health Advisory Board
The Rules establish the Rajasthan State Occupational Safety & Health Advisory Board, comprising representatives from:
* Labour Department
* Factories & Boilers Department
* Pollution Control Board
* Labour Commissioner
* Medical experts
* IIT Jodhpur
* MNIT Jaipur
* Employers
* Workers
* Safety experts
The Board will advise the State Government on occupational safety and health matters.
What Should Employers Do Now?
Organisations operating in Rajasthan should immediately:
* Review applicability under the OSH Code.
* Verify registration and licensing requirements.
* Shift to online compliance processes.
* Ensure appointment letters are issued to all employees.
* Plan annual medical examinations for eligible employees.
* Review accident reporting and emergency response procedures.
* Constitute Safety Committees where applicable.
* Appoint Safety Officers as required.
* Update internal SOPs and compliance documentation.
* Train HR, compliance and factory teams on the new Rules.
